<> Nebraska Supreme Court Issues Decision In Keystone XL Case - Decision for Thompson v. Heineman, Case No. S-14-0158. Although there was a majority (4) ruling in favor of the landowners that the law is unconstitutional, because of a lack of a super majority (5), required in Nebraska to rule on the constitutionality of a law, there was an impasse on the constitutional challenge to L.B. 1161 and it "cannot be resolved one way or the other in this case. . . Although we have four judges who conclude that L.B. 1161 is unconstitutional, we do not have five judges voting on the constitutionality of this enactment. Accordingly, we vacate the district court's judgment." |
